Who are we?
KARIBU is legally incorporated asFauteuils et meubles Karibu inc. In addition to its corporate name, KARIBU carries on business under the trade name KARIBU®.
KARIBU goods and services (the "KARIBU goods and services") are provided at karibu.cool and are described in these terms and conditions, which are available at karibu.cool. These terms and conditions, together with our privacy policy available at karibu.cool, apply to your use of our website and of the KARIBU goods and services.
The KARIBU goods and services provide access to reusable products intended to reduce the use of single-use plastic products, thereby contributing to greener and more sustainable practices that ultimately protect our planet.
Key terms and conditions
Please read these terms and conditions carefully, as they govern your access to our goods and services. The most important provisions are:

Access: the KARIBU goods and services are primarily intended for individuals who create an account on our site. When you create an account, you certify that the information you provide in your account is accurate, and you undertake to keep that information accurate and up to date as your circumstances change;

your rights and responsibilities as a user of the KARIBU goods and services, including your obligation to indemnify us against certain claims, and exclusions and limitations of our liability;

rights of suspension, cancellation and termination; and

changes to the KARIBU goods and services and to the price of KARIBU products over time.
You may use the KARIBU goods and services only if you have accepted these terms and conditions. These terms and conditions constitute a legally binding agreement between you and KARIBU. If you do not agree with these terms and conditions, or with our privacy policy, you may not and must not use the KARIBU goods and services.
KARIBU may terminate your access to the KARIBU goods and services if you fail to comply with these terms and conditions.
You expressly agree that, to the fullest extent permitted by applicable law, the KARIBU goods and services and content are provided "as is" and "as available", and that your use of and reliance on the KARIBU goods and services and content is at your own risk.
The laws of certain jurisdictions, including consumer protection and sale of goods legislation, may limit or restrict the following terms and conditions, and depending on where you reside, some of these limitations may not apply to you or may entitle you to additional rights.
KARIBU MAKES NO EXPRESS OR IMPLIED WARRANTY AND EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE WITH RESPECT TO THE GOODS AND SERVICES PROVIDED DIRECTLY OR INDIRECTLY BY KARIBU. WITHOUT LIMITATION AND NOTWITHSTANDING THE GENERAL NATURE OF THIS DISCLAIMER, IN NO EVENT WILL KARIBU, ITS THIRD-PARTY SUPPLIERS OR ANY OF THEIR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO PROFITS, LOSS OF TIME OR GOODWILL, EVEN IF KARIBU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE. You agree to hold KARIBU and its directors, officers, employees and representatives harmless from, and to indemnify and defend KARIBU, its directors, officers, employees and representatives against, any claim, demand for loss, liability or damage under these terms and conditions, including but not limited to claims for property damage, bodily injury or death, however caused, arising from any act or omission of KARIBU or its directors, officers, employees and representatives, or of any person acting on its behalf in the performance of this agreement; and all claims, actions and damages by anyone, by reason of the failure of KARIBU or its directors, officers, employees or representatives, or any person acting on its behalf, to comply with or perform any of the conditions,
To access the KARIBU goods and services, you must first complete a registration form providing the information KARIBU needs to create your account, then provide a valid payment method, generally a credit card or another payment method among those KARIBU makes available to users of its website. The prices KARIBU charges for the KARIBU goods and services apply solely to the KARIBU goods and services available online on the KARIBU website, subject to availability. You are responsible for all equipment, software and data services required to allow you to access the KARIBU website and place orders.
All prices, unless otherwise indicated, are in Canadian dollars. KARIBU does not refund the purchase price of the KARIBU goods and services once the products have been shipped or once the KARIBU services have been provided.
You consent, in accordance with the KARIBU privacy policy available at karibu.cool, to the collection and use by KARIBU of your personal information as contained in your account profile, for the purpose of allowing KARIBU to provide KARIBU goods and services to you. You must provide accurate and truthful information about yourself when completing our registration form, and that information, including the payment method you select, must be kept accurate and up to date.
When you register to access the KARIBU goods and services, you create a username and a password. Your password is the key to accessing the KARIBU goods and services and your account profile. You must keep your password confidential at all times. Your password may be used only by you, in accordance with your account profile. Your password must not be shared with another person to allow them to access the KARIBU goods and services.
You may access the KARIBU goods and services only after KARIBU has informed you that your registration is accepted. KARIBU reserves the right to refuse a registration request. For example, KARIBU may limit the number of users on its site in order to maintain the quality of the KARIBU goods and services, or exclude a user who does not comply with these terms and conditions. These are examples only and do not limit KARIBU's right to refuse a registration. KARIBU need not provide a reason for refusing a registration request or an order for KARIBU goods and services, and cannot be compelled to do so.
The completion of your account, your acceptance of these terms and conditions, your payment of the purchase price for the KARIBU goods and services you order from time to time on our website, and KARIBU's acceptance of your registration and of your order for KARIBU goods and services, taken together, form a legally binding agreement. These terms and conditions will be presented to you for review when you register for the KARIBU goods and services, and you will be asked to agree to comply with them before completing your registration, and from time to time when you purchase KARIBU products.
If at any time you no longer wish to be bound by these terms and conditions, you may deactivate your account, which will result in the deletion of your account profile.
The KARIBU goods and services, while primarily related to the sale of reusable, environmentally friendly and sustainable products, also provide access to information. From time to time, that information may include literary, musical, dramatic and artistic works, including but not limited to information, data, databases, text, code, algorithms, computer programs, methods or results of data analysis, graphics and graphical representations of data, software, sounds, sound effects, sound recordings, audio, video, cinematographic works, photographs, images and illustrations that are protected by Canadian and international intellectual property laws and treaties, including copyright laws, and that, unless otherwise indicated, are owned by KARIBU. All trademarks (including but not limited to trade names, logos, word marks and design marks) appearing in the KARIBU goods and services belong to KARIBU or to third parties, as the case may be, and are protected against reproduction, dilution and confusing or misleading uses. All of these items of information are referred to together as our "Content".
The KARIBU goods and services and content may contain third-party content, such as links to third-party websites and advertisements. Your use of or reliance on third-party content is solely at your own risk. Third-party content is not under KARIBU's control.
The KARIBU goods and services allow you to purchase KARIBU products that can be customized to your needs by letting you upload materials, including text and images ("customer materials"), to be printed on the KARIBU products you choose to purchase. By submitting customer materials to the KARIBU website, you represent and warrant to KARIBU that:

you own all copyright, trademark or other intellectual property rights in the customer materials;

by uploading the customer materials, you waive and release any moral rights you may have in those customer materials;

the customer materials contain no information you know to be false, inaccurate or misleading;

the customer materials are in no way obscene, hateful, offensive, threatening, harassing, defamatory or libellous toward anyone;

the customer materials contain no element likely to damage or interfere with KARIBU's programs, data or systems.
KARIBU does not guarantee that the KARIBU website or the KARIBU goods and services and content will be available in a timely manner without interruption, and you acknowledge that KARIBU will from time to time interrupt the availability of its website services for routine maintenance.
KARIBU may terminate your access to the KARIBU goods and services at any time, or revise, withdraw, discontinue, modify or suspend all or part of the KARIBU goods and services without notice, and will in no case be liable for modifying or discontinuing the KARIBU goods and services.
Online purchase of KARIBU products
All orders and purchases made through the KARIBU website are specifically subject to the following terms and conditions.
You agree to pay all charges related to your purchase of KARIBU goods and services, including the purchase price, shipping and handling fees and all applicable taxes. All prices shown on the KARIBU website are in Canadian dollars and all charges will be processed in Canadian dollars.
KARIBU may change or revise the information contained on this website at any time and without notice, in particular information regarding the price and availability of goods and services.
All prices shown on the KARIBU website must be confirmed at the time an order is placed and processed.
Restrictions on the sale of KARIBU goods and services

You must be 18 years of age or older to purchase products on the KARIBU website.

KARIBU may limit the quantity of KARIBU products you can purchase and may reject, correct, cancel or refuse orders, for any reason whatsoever, including if KARIBU determines in its sole discretion that you are not complying with these terms and conditions or that your use of the KARIBU goods and services is harming KARIBU's operations and business.

KARIBU will not be liable for delays in the delivery of KARIBU goods or services that are beyond its control.

KARIBU may provide your information to a third party to verify the billing and shipping addresses of orders placed on the KARIBU website. This verification process is intended to ensure that the addresses you provide match your credit card information and comply with these terms and conditions. Should KARIBU decide not to accept or fulfill an order, KARIBU will inform you and refund the associated credit card charges.
KARIBU is based in Canada and, for that reason, these terms and conditions will be interpreted and applied in accordance with the laws in force in the province of Quebec, Canada, without regard to conflict of laws rules.
These terms and conditions supersede all previous versions of the terms and conditions, and KARIBU may update or revise them at any time. Your use of the KARIBU goods and services constitutes your agreement to be bound by these terms and conditions as amended or revised from time to time.
